Timothy James Kelly was born in Glen Cove, New York. He earned his undergraduate degree from Duke University and received his Juris Doctor from Georgetown Law. He clerked at the U.S. District Court for the Eastern District of Pennsylvania.

He spent a decade as a federal prosecutor, serving first as an Assistant United States Attorney in the District of Columbia and then as a trial attorney in the Public Integrity Section of the Department of Justice’s Criminal Division. He went into private practice as a civil litigator.

He was nominated by President Donald Trump to serve as a United States District Judge of the U.S. District Court for the District of Columbia. His nomination was confirmed in the Senate by a vote of 94-2, and he received his commission in September 2017.

Kelly is married and has two children.

In the News…

A federal judge with the D.C. Circuit U.S. District Court struck down a rule that barred most migrants from receiving asylum at the southern border. He said the Trump Administration failed to follow the procedural law governing how regulations can be implemented, which requires advance notice and a period for the public to comment on the proposal.

“These procedures are not a mere formality,” Judge Kelly said.

The ruling will probably have little immediate impact in view of the president’s strict border restrictions over the coronavirus pandemic.
